Your paid leave benefits depend on the state or city where you work. Because laws vary by location, your leave policy is administered in accordance with the regulations that apply to your work location.
Paid Sick Leave
If your state or city requires paid sick leave, you will receive it in accordance with those rules.
Depending on where you work, sick leave may be provided in one of the following ways:
Accrual-Based Sick Leave
You may earn sick time based on hours worked. Common accrual rates include:
1 hour of sick leave for every 30 hours worked
1 hour of sick leave for every 40 hours worked
Your state may also set:
Annual accrual caps
Usage limits per year
Carryover rules
Lump-Sum (Front-Loaded) Sick Leave
Some states allow or require employers to provide a set number of sick hours at the beginning of the year instead of tracking accrual.
Mandated Paid Time Off (PTO)
Some states and municipalities require broader paid time off programs beyond traditional sick leave.
Where required, Worksome administers PTO in accordance with:
State-mandated accrual minimums
Carryover requirements
Annual usage limits
Separation payout rules (if applicable)
Your specific PTO policy depends on the laws that apply to your work location.
If applicable to your location, log into your Gusto account to review and request your time off balance, as well as usage history and paid time:
Requesting time off can be done both on a computer and through the Gusto mobile app.
On a computer
Click the Time Off tab on the left-hand side of your screen.
If your company has multiple time off policies, click on the policy you wish to request time off from.
If you do not see an unpaid time off policy to choose from, and you need to request unpaid time off, reach out to your employer to record this.
Click Request Time Off.
Select the day(s) you want to request off.
Full Days: 8 hours will be submitted for each business day (does not include weekends).
If you select a single date, a default amount of 8 hours will be entered. Update this number as needed.
Partial Days: A default amount of 8 hours will be entered, but you can change this number as needed.
Optional: Add a note to your employer about the request.
Click Send Request.
In the mobile app
Open the Gusto mobile app.
Go to the Time/Work tab.
If the Time tab does not appear on your mobile app homepage, reach out to your employer to see if this is a feature your company offers through Gusto.
Select Request Time Off.
Choose the policy you wish to request time off from.
Select the day(s) for your requested time off.
Full Days: This submits 8 hours for each business day (does not include weekends).
If you select a single date, a default amount of 8 hours will be entered. Update this number as needed.
Partial Days: A default amount of 8 hours is entered for each date. Update this number as needed.
Optional: Add a note to your employer about the request.
Click Submit Request.
Once Worksome receives the request for time off, the request will be submitted in Worksome for your manager's review and approval. Once it is approved, it will be processed for payment in Gusto.
To edit a request, delete the current one and then create a new request. You can cancel your time off request as long as it has not been processed through payroll.
Click the Time Off tab.
If your company has multiple time off policies, click on the policy you wish to cancel a request from.
Next to your pending time off request, click View.
Click Delete Request.
Note: If any portion of your paid time off has already been processed through payroll, the Delete Request option will no longer appear. Reach out to your company's payroll administrator to make the necessary adjustments.
Once you've requested time off, you can manage and view your time off request history by following the steps below.
Click the Time Off tab.
If your company has multiple time off policies, click into the policy you wish to view your balance and time off requests.
On this page, you can view:
Available Hours: Remaining time off hours you're available to use
Requested Hours: Your total Pending Requests + Approved Requests time off hours
Earning Policy: The rate at which you earn time off
Maximum Hours: If this is part of your company's time off policy, the maximum number of hours you can earn per year
Pending Requests: Your requested time off that has not yet been approved or declined
Approved Requests: Your approved time off that has not yet been paid in payroll (payroll has not yet processed for all requested dates)
Declined: Your requested time off that has been declined
Past Vacation/Sick Time: Your approved time off that has been paid in payroll (payroll has already processed for all requested dates)
Key time off terms
Waiting period – The number of calendar days an employee must wait before earning time off.
Example: An employee may need to wait 30 calendar days before time off starts accruing.
Maximum balance – The maximum amount of time off hours an employee can have at one time. If an employee has reached their max balance, but uses time off, they can earn more until they hit the max again.
Example: If the max is 20 hours and they use 5, they can earn back up to 20.
Carry-over limit – The number of accrued (unused) time off hours that can carryover to the next calendar year. This depends on the company’s rules or the employee’s hire date.
Example: Some people earn more time off every January 1st, while others earn it on their work anniversary (based on hire date).
