1. Send the external worker a job brief

The first step is to create the job brief to your worker (this part, is the same as it's always been! But we've added a quick reminder below for you):

In Worksome, click on Trusted Contacts:

Find the Trusted Contact you want to hire, and select Offer Job. Fill out the new Job Brief with all relevant information/requirements. Alternatively, you can use an Existing Job Brief:

Complete the Job Brief:
Here is where you add details about the job: description, rate, end date, location.

Note: For IR35, it is important to include scope of service - Details about the client, project, and delivery.

Once you've completed all relevant fields, select Offer Job:

2. Clarify contract type

After you've created the job brief, you'll move to step 2 of the IR35 process. Here you are asked to clarify the contract type. The contract type will determine whether you need to continue with the IR35 determination, or whether this job will be outside the scope of IR35.

If the contract type is a fixed-term employment no further assessment is needed as this contract type is outside the scope of IR35.

If the contract type is a Personal Service Contractor (PSC) IR35 determination is required.

Statement of Work (SOW)

When the worker is hired with the contract type Statement of Work, no determination is required

❕Find our FAQ on Statements of Work here.

In this example, we will choose Personal Service Contractor (PSC), and you will get to the IR35 determination questions:

This is followed by 6 questions for the contracted worker to answer. This will usually be completed by the worker in their own account already, and their answers will automatically reflect here for you.

Finally, the last three questions are for the hiring manager to answer about this specific hire:

3. Status Determination Statement (SDS)

Now, all the required questions are answered, and you'll be able to Create and Approve the SDS, in your Conversation for the job:

You'll see the determination result on the SDS. You'll need to review & Confirm Acceptance of the SDS:

That's it!

The IR35 determination is done and the Status Determination Statement is ready for you and for your worker to download.

You'll then just confirm the usual Contract Details for the hire and Save Changes.
Your worker will receive their contract offer and SDS result, for them to review & accept.

Editing an IR35 Booking

If you've found that you may have answered a determination question incorrectly, you can re-do the determination.
Firstly, head to your Conversation for the job in Worksome.

Here, in your SDS menu, you can Redo the SDS.

After confirming you want to redo the SDS, you will see the following notification on the top of the screen, and you can now amend any incorrect IR35 answers for your hire. You can also edit the worker's answers, if they have advised you that any of their responses are incorrect or missing.:

When you're ready, hit Save, and you can now Create and Approve SDS, with your new amendments:

You'll see the determination result, based on your new answers, which you'll need to confirm your acceptance of, as before.

That's it!

The IR35 determination is done and the Status Determination Statement is ready for you and for your worker to download.
